The American Spectator has announced the publication of an article addressing ethical concerns and legal gaps in commercial surrogacy. The piece highlights cases of child abuse and exploitation, which have led to calls for stricter regulation.

According to The American Spectator, commercial surrogacy presents moral, legal, and social dilemmas that extend beyond traditional family structures. The article explains that gestational surrogacy intentionally separates children from their birth mothers, while traditional surrogacy complicates matters further by making the surrogate the biological mother. It emphasizes that although surrogacy is celebrated in many circles, it remains largely unregulated, leaving children and women vulnerable to exploitation.

As reported by Reduxx, a Pennsylvania man named Brandon Keith Riley-Mitchell, who is a convicted sex offender, managed to gain custody of a surrogate-born child through legal loopholes. Pennsylvania law prohibits sex offenders from adopting or fostering children but does not restrict access to surrogacy. This allowed Riley-Mitchell to obtain a pre-birth parentage order. Reduxx notes that this case has sparked widespread outrage and prompted lawmakers to advocate for reforms aimed at closing these dangerous gaps in state law.

According to The New York Post, a Southern California couple with 21 surrogate-born children was arrested in 2024 on suspicion of felony child endangerment after one baby was hospitalized with head injuries. Police discovered surveillance footage allegedly showing nannies violently shaking and striking an infant, leading to further investigations into abuse within the household. Experts cited by the Post, including those from the Center for Bioethics and Culture Network, warn that the fertility and surrogacy industry lacks sufficient oversight, creating opportunities for exploitation and abuse.
