Guatemalan man sentenced for illegal reentry after prior removals

Jose Domingo Aguilar, a 38-year-old Guatemalan national residing in Franklin County, Pennsylvania, was sentenced to time served—approximately six months—and faces possible deportation after pleading guilty to illegal reentry. The sentencing was handed down by Senior United States District Judge Malachy Mannion, according to an announcement from the United States Attorney’s Office for the Middle District of Pennsylvania.

United States Attorney Brian D. Miller stated that Aguilar was discovered in Franklin County on September 23, 2025. At that time, he had been charged and pleaded guilty to one count of Driving Under the Influence (DUI), one count of DUI with a blood alcohol content over 0.16, two summary counts of driving with a suspended license, and one summary count of disregard for traffic laws. These charges were filed by the Chambersburg Police Department in Chambersburg, Pennsylvania.

Miller noted that Aguilar had previously been removed from the United States three times, most recently through Texas in 2015. He reentered the country without obtaining legal permission.

The case is part of Operation Take Back America (https://www.justice.gov/dag/media/1393746/dl?inline), a nationwide initiative aimed at using resources from the Department of Justice to address illegal immigration and combat transnational criminal organizations. This operation also incorporates efforts from Project Safe Neighborhoods.

The investigation was conducted by U.S. Immigration and Customs Enforcement and Removal Operations. Assistant U.S. Attorney Kelley K. McGraw prosecuted the case.
