A federal grand jury has indicted Alita Stewart, 51, and Hugh Berry, 41, on charges related to contraband at the Federal Correctional Institution-Schuylkill in Schuylkill County, Pennsylvania. The announcement was made by the United States Attorney’s Office for the Middle District of Pennsylvania.

According to United States Attorney Brian D. Miller, “the Indictment alleges that on or about August 17, 2025, at the Federal Correctional Institution-Schuylkill in Schuylkill County, Pennsylvania, Stewart, a Maryland resident, provided and attempted to provide Hugh Berry, a federal inmate, with a purple bundle containing a mixture or substance containing marijuana.”

The case is being investigated by the Federal Bureau of Investigation (FBI) and the Federal Bureau of Prisons Special Investigative Service. Assistant United States Attorney Tatum R. Wilson is prosecuting.

If convicted under federal law for these offenses, the maximum penalty could be five years in prison as well as supervised release and a fine. Sentencing will be determined by a judge based on federal statutes and guidelines.

Officials emphasized that indictments are not evidence of guilt. “Indictments are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court,” according to the statement.
