Pa. judge orders ballots separated

Pennsylvania Commonwealth Court President Judge Mary Hannah Leavitt ordered that ballots where identification is received after Nov. 9 be separated from those that are received and verified before that date.

The ballot segregation is in addition to previous segregation of ballots that were received after Nov. 3 at 8 p.m. and before Nov. 6 at 5 p.m., according to the Nov. 5 order

“The segregated ballots for which identification is received and verified on November 10, 11, and 12, 2020, shall not be counted until further order of this Court,” Leavitt ordered.

President Donald Trump and the Republican National Committee filed a lawsuit against all 67 Pennsylvania county boards of election seeking an injunction to prohibit the boards from permitting absentee and mail-in voters from providing proof of identification after Nov. 9. Pennsylvania Secretary of the Commonwealth Kathy Boockvar was also named as a defendant in the suit.

The petitioners wanted an injunction to prohibit the counties from allowing absentee and mail-in voters who were missing proof of identification after Nov. 9 to not have their votes counted in the election.

Leavitt ordered Boockvar to provide a copy of the order to all county boards of elections.
