Two Republicans want the U.S. Supreme Court to stop the certification of the state’s election results and have filed an appeal.
U.S. Rep. Mike Kelly (R-PA) and congressional candidate Sean Parnell, along with other Republicans, believe that there is a chance for the high court to take up their case because they allege that the Pennsylvania Supreme Court didn’t grant their emergency stay.
Kelly and Parnell also have the support of U.S. Sen. Ted Cruz (R-TX). Cruz also wants the Supreme Court to hear the case.
Cruz believes that the state’s dismissal was wrong.
“In the current appeal, the Pennsylvania Supreme Court dismissed the claim based on a legal doctrine called ‘laches,’ which essentially means the plaintiffs waited too long to bring the challenge. But, the plaintiffs reasonably argue that the Pennsylvania Supreme Court has not applied that doctrine consistently and so they cannot selectively enforce it now,” Cruz said in a news release.
Cruz believes the state court has entangled them in a “Catch-22” because if they had filed before the election, they would’ve lacked standing, but now that it is after the election, they’ve waited too long.
Cruz said in the release that these are not ordinary times and that the U.S. Supreme Court should absolutely take up the case.
The Republicans claim that if the U.S. Supreme Court agrees to take up the appeal, there’s a fair chance it will reverse the commonwealth’s decision.
Pennsylvania Secretary of State Kathy Boockvar and Gov. Tom Wolf argued against the high court taking up the case.
“It is simply too late to invoke the U.S. Constitution now; they have waived their arguments. For this reason, and because the fatal flaws in Petitioners’ original case mean that the Supreme Court of the United States is highly unlikely to grant relief, this Court should deny Petitioners’ Application,” according to the filing, the Epoch Times reported.
