President Donald Trump's attorney has filed a Motion for Leave to Withdraw as Counsel.
Jerome M. Marcus of Marcus & Auerbach LLC filed his request in the U.S. District Court for the Eastern District of Pennsylvania on Jan. 7, a day after the Capitol Hill violence occurred.
Citing a statute, the Pennsylvania Rule of Professional Conduct 1.16 (b) (3) and (4), which stipulates that counsels can withdraw from cases if the client uses them to “perpetrate a crime or fraud", Marcus alleges that he was used by President Trump to aid a crime.
“Inasmuch as the client has used the lawyer’s services to perpetrate a crime and the client insists upon taking action that the lawyer considers repugnant and with which the lawyer has a fundamental disagreement,” Marcus stated on his motion.
In a separate correspondence, Marcus said that cases have been filed by the president to incite people to violence specifically to urge supporters to come to the national capital to protest.
U.S. District Judge Paul S. Diamond ordered him to serve a copy of his motion to the campaign.
Marcus was one of the counsels in the Donald J. Trump For President, Inc v Philadelphia County Board of Elections, Case no. 20-5533, challenging the election results.
